TradeBeacon Terms of Service

Welcome to TradeBeacon. These Terms of Service ("Terms") govern your access to and use of the website located at tradebeacon.org and all related tools, features, and services (collectively, the "Service") operated by TradeBeacon ("TradeBeacon," "we," "us," or "our"). By creating an account, accepting these Terms during signup, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What TradeBeacon Is — and What It Is Not

TradeBeacon is an educational and analytical platform for traders. The Service includes tools such as a market simulator, market replay, trade logging, profit-and-loss (P&L) tracking, journaling, analytics, and AI-assisted coaching features.

TradeBeacon provides market data and educational tools only. Nothing on this platform constitutes financial, investment, or trading advice.

Specifically:

We are not a broker-dealer, investment adviser, commodity trading advisor, or financial institution, and we are not registered with the SEC, CFTC, FINRA, NFA, or any other financial regulatory authority.
No content on the Service — including simulator results, replay data, analytics, AI coach output, notifications, or any other feature — is a recommendation to buy, sell, or hold any security, futures contract, or other financial instrument.
Any trading decisions you make are yours alone. You should consult a licensed financial professional before making investment decisions.

2. Simulated and Historical Data Disclosure

The TradeBeacon simulator uses synthetically generated market data. Simulator prices, candles, and volume are produced by our own simulation engine and do not represent real market prices, real securities, or real trading conditions. Market replay features may use historical or reconstructed data for educational review.

Simulated or hypothetical trading performance has inherent limitations. No representation is made that any account will or is likely to achieve profits or losses similar to those shown in the simulator, in replay, or in any analytics. Past performance — real or simulated — does not guarantee future results. Trading real financial instruments involves substantial risk of loss and is not suitable for everyone.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, Lifetime Access, and Billing

Plans. We offer paid access to the Service, including recurring subscription plans (billed monthly or as otherwise stated at checkout) and a one-time "Lifetime" purchase.
Payment processing. Payments are processed by Stripe. We do not store your full payment card details.
Monthly subscriptions renew automatically each billing period until canceled. You may cancel a monthly subscription at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
Lifetime access is a one-time payment granting ongoing access to the Service features included in that plan for as long as we operate the Service. "Lifetime" refers to the life of the Service, not the purchaser.
Promotional codes. From time to time we may offer promotional codes (for example, a code granting a free first month). Promo codes are limited to one per customer unless stated otherwise, have no cash value, may not be combined with other offers, and may be modified or discontinued at any time. Abuse of promotional codes (including sharing non-public codes) may result in revocation of the promotion and/or account termination.
Refunds. Except where required by applicable law, all payments are final and non-refundable. Canceling a monthly subscription stops future charges but does not entitle you to a refund of amounts already paid.
Price changes. We may change subscription pricing with reasonable advance notice. Price changes apply at your next renewal; they never apply retroactively and do not affect Lifetime purchases already completed.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable law;
Share, resell, or transfer your account or access credentials;
Copy, scrape, reverse engineer, or redistribute the Service, its data, or its content, except as permitted by law;
Interfere with or disrupt the Service, its servers, or its security features, or attempt to access data belonging to other users;
Misrepresent TradeBeacon output as financial advice when sharing it with others;
Use automated systems to access the Service in a manner that sends more requests than a human could reasonably produce.

7. User Content

You retain ownership of content you submit to the Service, such as trade logs, journal entries, notes, and imported data ("User Content"). You grant us a limited license to host, store, process, and display your User Content solely to operate and improve the Service. You are responsible for your User Content and represent that you have the rights necessary to submit it.

8. Intellectual Property

The Service — including its software, design, text, graphics, and branding — is owned by TradeBeacon or its licensors and is protected by intellectual property laws. Charting functionality may be provided under license from third parties (including TradingView); such components remain the property of their respective owners and their attribution must not be removed. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.

9. Third-Party Services

The Service relies on third-party providers, including payment processing (Stripe), infrastructure and authentication (Supabase), email delivery, and charting technology. Your use of those components may be subject to those providers' terms. We are not responsible for third-party services we do not control.

10. Notifications and Communications

By creating an account, you consent to receive transactional and service-related emails (such as receipts, account notices, and — if enabled — P&L summary reports). You can manage optional notifications in your account settings. Browser notifications require your device-level permission and can be disabled at any time.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA (INCLUDING SIMULATED MARKET DATA, ANALYTICS, OR P&L CALCULATIONS) WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEBEACON AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, TRADING LOSSES, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless TradeBeacon from claims, damages, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.

14. Termination

You may stop using the Service or delete your account at any time. We may suspend or terminate your access if you violate these Terms, abuse promotions, or use the Service in a way that risks harm to us or others. Upon termination, your license to use the Service ends; Sections 1, 2, 7–8, and 11–17 survive termination.

15. Changes to the Service or These Terms

We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will provide notice (for example, by email or in-app notice) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in North Carolina, and you consent to their jurisdiction. Nothing in this section prevents either party from pursuing claims in small-claims court.
